Licenses and credentials

The Brazilian legislation establishes that all lubricating oil used must be re-refined. Discarding it in any other way is an environmental crime. The disposal rules are regulated by the laws of Conama (National Environment Council) and the ANP (Brazilian National Agency of Petroleum, Natual Gas and Biofuels) respecting the National Solid Waste Policy.

All our activity is certified by inspection bodies through the issuance of operating licenses.

You can consult the licenses issued by the ANP (National Petroleum Agency) and Environmental Agencies that your company needs to prove traceability by accessing the customer's exclusive area under “Request your collection“ (Note: access to licenses is independent from collection schedules.)

What is the necessary documentation for those who generate used lubricating oil?
The generator has the obligation to prove that the lubricating oil used was intended following the current legislation, requiring the Certificate of Used Oil Collection (CCO) in its name and verifying whether the collecting company has ANP Operating Authorization, Environmental Licenses and IBAMA registration of the collecting and destined company.

What licenses should I charge the collector?
  • CCO according to the ANP resolution of 2009
  • ANP authorization for collection
  • ANP Authorization to re-rerefining or contract with the authorized Refinery by ANP
  • Transportation license from the state environmental agency
  • Operating license from the temporary storage base of the state environmental agency (where applicable: for when the oil does not go straight to the refining plant - final destination)
  • Valid IBAMA Records: CTF and Transportation Authorization

How do I find LWART Environmental Solutions licenses?
Environmental licenses can be found here on the website, in the customer exclusive area. Just register and access Request your collection. Access to licenses is independent of collection schedules.

How do I prove that the oil used was collected and destined according to the current legislation?
Two documents are required: to prove the collection, the document is the Certificate of Used Oil Collection (CCO,) and to prove the final destination, the Final Destination Certificate (CDF) that can only be issued by the rerefinery. The CCO delivered at the time of collection must be stored for 5 years by the generator.

How do I require the CDF?
We request the customer to send an email with the company data and period that must contain in the final destination certificate (CDF) to operacoesdecoleta@lwart.com.br.

Is the generator required to issue Invoice for sale of used lubricating oil?

What are the consequences of not storing and allocating used oil properly?
In addition to contaminating the environment the irregular custody and improper disposal of OLUC is an environmental crime and all those involved will be subject to the penalties established by the legislation such as the payment of severe fines, liability for environmental damage caused, suspension of the establishment authorization, in addition to responding criminally and suffer application of the imprisonment penalty from 1 to 4 years and fine.

What is the correct destination of OLUC?
The only correct destination is recycling through the re-refining process. The Current legislation (CONAMA No. 362/2005) establishes that all OLUC must be gathered, collected and destined for refining.

How should I store OLUC?
The containers in which the waste will be packed must be in good conditions, free of leaks and placed inside the area with containment.
